Booking and Payment

All bookings made with Cornwall Private Tours are subject to availability and acceptance. A booking shall only be deemed confirmed and valid once full payment has been received in cleared funds. Full payment is required at the point of booking. Payment of the booking amount constitutes acceptance of these Terms and Conditions.

 

Changes by You

If you wish to make any changes to your booking arrangements after your confirmation invoice has been issued, you must notify Cornwall Private Tours in writing as soon as possible. Such requests must be made by the first-named person on the booking.

Whilst we will make reasonable efforts to accommodate your requested changes, we cannot guarantee that we will be able to do so. Where we are able to meet your request, all changes will be subject to any additional costs incurred, including costs to Cornwall Private Tours and any costs or charges imposed by third-party suppliers.

Please note that these costs may increase the closer the request is made to the departure date. If we are unable to accommodate your requested changes and you do not wish to proceed with the original booking, this will be treated as a cancellation by you and the applicable cancellation terms will apply (see “Cancellation by the Customer”).

 

Cancellation by the Customer

Should you wish to cancel your booking, written notice must be provided to Cornwall Private Tours. The following cancellation charges apply:
Cancellations made within 30 days of the tour departure date:
The full booking amount will be charged. No refund will be issued.
Cancellations made more than 30 days prior to the tour departure date:
An 80% refund of the total booking cost will be issued, subject to Cornwall Private Tours being able to recover costs from third-party suppliers and subcontractors.
These charges reflect the genuine costs incurred in arranging private tours and securing third-party services. Any applicable refunds will be processed to the original payment method within a reasonable timeframe once all recoverable costs have been confirmed.

 

Changes to Tours by Cornwall Private Tours

Cornwall Private Tours reserves the right to make changes to tour itineraries, routes, timings, vehicles, or services where necessary due to operational requirements, weather conditions, safety considerations, or circumstances beyond our control. Where a significant change is required, we will make reasonable efforts to notify you as soon as possible and offer a suitable alternative. No refunds will be provided for minor changes that do not materially affect the overall tour experience.

 

Force Majeure

Cornwall Private Tours shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control. These events include, but are not limited to, acts of God, adverse weather conditions, natural disasters, pandemics, government restrictions, strikes, transport disruptions, or any other circumstances outside our control. In such circumstances, Cornwall Private Tours reserves the right to amend, reschedule, or cancel a tour. Refunds, where applicable, will be subject to the recovery of costs from third-party suppliers and subcontractors and may not be guaranteed.

 

Third-Party Suppliers

Cornwall Private Tours utilises third-party suppliers and subcontractors, including but not limited to accommodation providers, transport operators, and attraction providers. Refunds outside of 30 days are dependent on the terms and conditions imposed by these third parties. Cornwall Private Tours cannot guarantee refunds where such costs are non-recoverable.


Customer Responsibilities

Customers are responsible for being ready at the agreed pick-up location and time. If a customer is late, Cornwall Private Tours may adjust the tour itinerary, shorten the tour duration, or reschedule the tour, and no refund will be issued for lost time. Customers must ensure they provide accurate booking information, including contact details and any relevant requirements, at the time of booking. Cornwall Private Tours cannot be held responsible for issues arising from incorrect or incomplete information provided by the customer.

 

Your Behaviour

All guests travelling with Cornwall Private Tours are expected to behave in an orderly and acceptable manner and not disrupt the enjoyment, safety, or comfort of others. If, in our reasonable opinion, or in the opinion of any accommodation manager or person in authority, the behaviour of any guest or member of your party:
Causes, or is likely to cause, distress, danger, annoyance, or damage to others or property,
Causes a delay, diversion, or disruption to transportation or services,
we reserve the right to terminate your booking arrangements immediately. In such cases:
Our liability to you and/or your party ceases immediately,
You and/or your party must leave the accommodation or service without delay,
No refunds will be made for lost services or expenses incurred,
You and/or your party may be liable for any damage or losses caused, and full payment for these must be made directly to the supplier before departure. If payment is not made, you will be responsible for any claims (including legal costs) resulting from your actions, including costs Cornwall Private Tours incurs pursuing the claim.
Cornwall Private Tours cannot be held responsible for the actions or behaviour of other guests or individuals unconnected with your booking.

It is the Party Leader’s responsibility to ensure that all participants:
Under 18 do not consume alcohol and all participants comply with local alcohol laws,
Do not consume alcohol to excess,
Comply with local laws,
Do not use illegal substances,
Smoke only in designated areas, avoiding fire hazards,
Wear seat belts on all journeys by minibus, coach, or other transport,
Act responsibly and avoid behaviour likely to cause offence or damage to property.

Special Requests

Any special requests must be advised to Cornwall Private Tours in writing at the time of booking (e.g., dietary requirements, room location, particular facilities). Whilst every effort will be made to accommodate reasonable requests, we cannot guarantee they will be fulfilled. The fact that a special request has been noted on your confirmation invoice, other documentation, or passed to a supplier does not confirm that it will be met. Failure to meet a special request will not constitute a breach of contract. We do not accept bookings that are conditional upon any special request being met.


Disabilities and Medical Problems

Cornwall Private Tours is not a specialist disabled tour company, but we will do our utmost to accommodate any requirements you may have. If you or any member of your party has any medical need or disability that may affect your participation, you must provide full details before we confirm your booking so we can advise on the suitability of your chosen arrangements. We may require a doctor’s certificate certifying fitness to participate. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking. If full details are not provided at the time of booking, we may cancel the booking and apply the applicable cancellation charges once we become aware of these details.


Travel Insurance & Liability

We strongly recommend that all customers take out adequate private travel insurance to cover cancellation costs, personal belongings, medical treatment, or injury. Cornwall Private Tours cannot accept liability for loss, theft, or damage to personal belongings. Except where caused by our negligence, Cornwall Private Tours is not liable for accidents, injuries, or health issues incurred during the tour. Customers participate at their own risk and should ensure they have sufficient insurance to cover all eventualities.


Personal Information and Privacy

By accepting these Terms and Conditions, you consent and authorise Cornwall Private Tours to request, collect, and process personal information relating to you and your party from contracted service providers, in accordance with UK data protection legislation. We process personal information solely to the extent necessary to allow us and our suppliers to deliver your tour and related services. Your personal information and that of your party is important to us. Should you have any questions about how we handle your personal information, please refer to our Privacy Policy, which can be found on our website at: https://www.cornwallprivatetours.co.uk/privacy-policy. If you wish to stop receiving communications from us, by email or any other means, please contact us at [email protected] detailing how you wish us to use and store your personal information.


Compliance with UK Consumer Law

Nothing in these terms and conditions is intended to exclude or limit any rights you may have under applicable UK consumer law. Cornwall Private Tours will always act reasonably and in good faith when applying these terms, including in relation to cancellations, refunds, and changes to tours.


Jurisdiction and Applicable Law

These Booking Conditions and any agreement to which they apply are governed in all respects by English law. Both Cornwall Private Tours and the customer agree that any dispute, claim, or other matter arising out of or in connection with your booking or contract will be dealt with exclusively by the courts of England and Wales.
